Marguritte Lady Culpeper Thomas Lord ffairfax and Catherine his Wife Proprietors of the Northern Neck of Virginia To all to whom this present Writing shall Come send Greeting in Our Lord God Everlasting Whereas Lieut. Collo. Joseph Ball of Lancaster County upon his Suggestion of a Certain Quantity of Land belonging to Us not yett granted to any P[er]son in ye. [said?] County did on ye. Twenty Eight Day of March Last Obtain a Warrant from Our Office for Laying out [ye.?] same, and having now Returned a Survey thereof under ye. hand of Edwin Conway Surveyor Know Yee Therefore that Wee for and in Consideration of the Composition to Us paid, and ye. Annuall Rent hereafter Reserv[ed], Have Given and Granted, and do by these Presents give and Grant unto ye. said Lieut. Collon:ll Joseph Ball, all that Tract and Parcell of Land lying in the Aforesaid County of Lancaster and Bounded as followeth Vizt. Begining at a White Oak Standing by a Dead Corner Tree of a Tract or Land belonging to ye. said Lieut. Collo. Joseph Ball, the said White Oak is ye. Westermost Corner Tree of a Tract of land now in ye. Possession of Duke Sanders, from ye. said White Oak Running along ye. said Sanders his Line [North?] ffifty four Degrees East to a Creek Dividing this from Battranos Land, thence down along the said Creek Severall Cources to a Marked Pine Another Corner Tree of ye. Aforesaid Tract of Land belonging to ye. said Lieut. Collo. Joseph Ball, thence along his Line North four Degrees East to ye. first Mentioned Station Containing and being Laid Out According to ye. said Survey for Eighty Acres of Land Together w[i]th all Rights Members and Appurtenances thereunto belonging Royall Mines Excepted and the full third part of all Lead Copper Tinn Coles and Iron Mines that shall be found thereon To have and to hold the said Eighty Acres of Land Together w[i]th all Rights Profitts and Benefitts to ye. same belonging or in any wise Appertaining Except before Excepted to him ye. said Lieut. Collo. Joseph Ball his Heirs and Assigns for ever, he the said Lieut. Collo. Joseph Ball his heirs and Assigns therefore Yeilding and Paying to Us Our Heirs, Assigns or to ye. Certain Attorney or Attorneys of Us the said Proprietors or to ye. Attorney or Attorneys of Our Heirs or Assigns Proprietors of the said Northern Neck Yearly and Every Year on ye. feast of St. Michaell ye. Arch Angell the ffee Rent of One Shilling Sterling Money for every ffifty Acres of Land hereby Granted Provided That if ye. said Lieut. Collo. Joseph Ball his Heirs or Assigns Shall not Pay ye. before Reserved Annuall Rent soe that the same or any part thereof shall be behind or unpaid for ye. Space of Two whole Years after ye. same shall become Due if Lawfully Demanded that then it shall and may be Lawfull for Us Our heirs or Assigns Certaine Attorneys or Agents into ye. Above Granted Premises to Re Enter and hold ye. same soe as if this Grant had never Passed, Given at Our Office in Lancaster County w[i]thin Our said Proprietory under Our Seale Wittness Our Agent and Attorney fully authoriz'd thereto Dated ye. ffourth Day of December In ye. Third Year of ye. Reigne of Our Sovereigne Lady Ann by ye. Grace of God of England Scotland ffrance and Ireland Queen Defender of ye. faith &c. Annoq[?] Domini 1704.
