Transcribed on 3 March 2010 by Sheila Schmutz from a photocopy sent to me by Jimmy Fread Oliver which he obtained from the county clerk in Princeton, Caldwell County, Kentucky.
p.431-432

In the Name of God Amen. I Levin Oliver of the County of Caldwell and State of Kentucky, being of sound mind and Memory, and knowing that it is appointed of God for all men once to die, do make, ordain, constitute and appoint this my last Will and Testament, and desire it to be received by all as Such.
First I desire that my body be buried decently interred, without ?? or parade.
Secondly, I desire that all my worldly debts, which are few, be justly paid.
Thirdly I will and bequeath to my beloved wife Elizabeth Oliver the Tract of land on which I live, supposed to be Twenty acres, to her entire use & benefit, during her natural life. After her death I desire that the said Land descend to my Grandson Joseph Olliver, son of Josies Olliver. And that the said Josies (^after her death or aft) have the entire use & benefit of the sd premises, until said Grandson becomes of age.
Fourthly I give and bequeath to my said Wife, all stock of every description, all my farming utensils, house-hold and Kitchen furniture to be hers during her natural life. And after her death I desire that the sd property be sold to the highest bidder, and the proceeds thereof equally divided amongst all my Children (Towit) Nathan Olliver, Leonard Olliver, William Oliver, Hezekiah Oliver, Cornelius Oliver, Elizabeth Cummins, Levin Oliver and Josies Oliver.
Fifthly I appoint my Wife Elizabeth Oliver and my son William Oliver Executrix and Executor of this my last Will and Testament and request that no security be required of them as such. In Testimony that I do Acknowledge this to be my last Will and Testment I have fit my hand and affixed my Seal this 26th day of May 1830.
Levin Oliver (his mark) (Seal)
Witness
Wm Mercer
Wm Oliver
Josiah Oliver
State of Kentucky, Caldwell County ?
At a County Court begun and held for the County afsd on Monday the 19th day of July 1830. The written last Will and Testament of Levin Oliver decd produced in open court and proven by the Oath of William Mercer as suscribing? Witness thereto, and the form? was thereupon Ordered to them.
In Testimony thereof and that I have truly recorded the form together with this Certificate in my Office, I hereunto let my hand as Clerk afsd Court, this 19th day of July 1830.
N. L. Dallam Clk
___________
NOTE: People have seen the name Josies/Josiah/Josier in various ways. The abstract of this will in "Pioneers of Caldwell County Kentucky, Volume I, Probate Records of the Original Settlers 1809-1834 by Olive Eldred and Nancy Beck” refers to this person as Josie Oliver, and then assumed she was a daughter. Even they read the witness as Josiah Oliver however.
Daniel T is Daniel P (Pomeroy) who is the son of Daniel in the 1830 census.
Philander is also the son of Daniel in the 1860 census.

I am the ggg grandson of Daniel P. I have this line traced back many more generations but have not had a connection with Isaac. He could be a son of one of the brothers of Daniel - there were 4. I do not have their information.

Hello,
I am the great great grandaugher of Ira and Cora. I am also trying to find information on them. My Great Grandmother was Thelma V. Oliver (she is listed in the 1920 census and Selma). She married Perley Otto Cook 15 Oct 1923 in Marion Co., IN. I knew her from when I was a small child, but had never known her husband, Otto as he was called. He actually had left when my grandfather was young, and then apparently got killed at a young age. I have not been able to find much on him either. However, I did find Ira and Cora in the 1930 Decatur, Marion Co, IN census. If you have more info on either one of them, before they appear in the 1920 census, I would much appreciate it. I am having a hard time finding anything.
Thanks,
Gina Fannin

The only information regarding my family that pre dates 1830 is in regards to birth dates of my ggg grandfather, Isaac Oliver, and his brothers and sisters and his mother, Phoebe Hazen b. 1800. 1830 was just the census year in which I found the largest concentration of Olivers in the area my ggg grandfather was born, the Niagara county area. It is possible that your Leonard Oliver is related but I am unable to assist you with that information. I am trying to find my possible connections as well.

Brian, I have a Leonard Oliver, born abt 1803 in Canada, who claimed his parents were from New York. I do not know where in New York, but other information leads me to suspect they may have lived in the Niagra area before the Rev. War. I see that your information seems to go no further back than 1830. Do you have any information on pre-Rev. War Olivers?

I am finding more and more Olivers from this area of New York. I have posted many times before looking for information on my Oliver ancestors from that area. Isaac Oliver b. 1824 in Pendleton, Niagara, New York was the son of Peter Oliver (married to Phoebe Hazen.)
I have found in the Niagara area, even in Pendleton a:
George C. Oliver 1830 US Census Pendleton
George Oliver Jr 1830 US Census Pendleton
Daniel Oliver 1830 US Census Cambria
Daniel T. Oliver 1830 US Census Lockport
Elisha Oliver 1830 US Census Lockport
Franklin Oliver 1830 US Census Wilson
Elson Oliver 1830 US Census Lockport

In the 1860 Census there are even more Olivers in Niagara County:
Bruce Oliver
Charles
Cynthia
Edward
Florence
George
Thomas
Henry Julius
Philander
the list goes on

Some of these Olivers have to fall in with my Oliver line.
I forgot to mention, in the source for most of this information I also noticed that George Levalley, Peters wifes second husband, he left land to a Richard Oliver. Richard was not a son of Peter. Maybe a brother or nephew? It was mentioned by a fellow family member of mine that she had found a David Oliver related to Peter who was either a brother or his father. I have been able to find no leads in either of those directions.

My Peter was married to Phoebe Hazen b. ~1800 in New Jersey, who later married George Thomas Levalley. Of their children, atleast one was born in New York in 1824, Isaac Oliver (my direct line.) They lived in the Pendleton, Niagara area of New York state. Peter was either dead or had divorced Phoebe by 1839. I know nothing else about Peter Oliver.

There are several Dionysius Oliver, even though the name is unusual. I do not find which one is meant in this string.

There is a Peter Oliver born in 1790 in the Orangeburg Dist of SC and some of the Dionysius lived in that general area of SC then.

1850 South Carolina > Orangeburg > Between Santee and Edisto North of Belville Road > Image 15
122 Oliver Peter 60 abt 1790 Male South Carolina
122 Oliver Mary 55 abt 1795 Female South Carolina
122 Oliver Samuel 27 abt 1823 Male South Carolina
122 Oliver Thos W 22 abt 1828 Male South Carolina
further up the same page - likely another son?
118 Oliver Glenn 40 abt 1810 Male South Carolina
118 Oliver Eliza A 34 abt 1816 Female South Carolina
also several more on other pages

_______
There is also a Peter Oliver with a son and brother named Dionysius in the Edgefield District of SC.
Note that in the will of his brother Dionysius Oliver who died in 1815 in Edgefield District, SC
"But should it so happen that my son Lewelling Oliver should die without Issue Then and in that case it is my will and I do give six hundred Dollars to my nephew Dionysius Oliver son of my brother Peter Oliver, also I give to my nephew Berrien Oliver son of Dionysius Oliver six hundred dollars."
But I suspect this Peter was born about 1770.

_______
There was also a Peter Oliver in the 1790 census list for Elbert Co, GA where yet another Dionysius lived.

_____

Perhaps with more details on your Peter, like a place or descendant or wife......we could be more helpful. But there are many.

Sheila Schmutz

My 4th g-grandparents were Durrett Oliver (1787-1847) and Elizabeth Meerk Stephens Oliver (1785-1873). Durret was the son of RWS Douglas Oliver (1753-1843). They moved from VA (pausing for a few years in TN and AL) and settled in Randolph Co, IL around 1825. By 1840 they had moved to Grant Co, WI. Durrett died in 1847 and Elizabeth accompanied three of her daughters west to Stockton, CA where she died and was buried. They had 14 children of whom 11 lived to adulthood:

* Solomon Oliver (1806-1888) d. Lafayette Co, WI
* Isaac Stephens Oliver (1809-1843) d. Dr. James Clairborn Campbell.
* Durrett Oliver Jr. (1823-1845) d. Grant Co, WI?
* Cynthia Oliver (1825-before 1900) d. San Joaquin or Tulare Co, CA m(1). William Whitfield Wright, m(2). George Hastings Castle
* Harriet Oliver (1829-1882) d. San Joaquin Co, CA m.
Olivers of New York (David of Union Springs, Peter, Isaac of Pendleton)

My g-g-g grandfather was Isaac Oliver (b. 1824, New York). His father is said to be Peter Oliver who m. Phoebe Hazen. Now through a gentleman kind enough to share some information with me some time back I have managed to find a relative of Peter who is either a brother or his father. A Sarah Oliver, relative of Isaac and Peter, was given land by the will of David Oliver of Union Springs, Cayuga Co, New York. I found an article of who I can only assume is the same David Oliver I mention here (article found at the bottom of this post.) Does anyone have information on this David Oliver who died in New York between 1840-1858? This person could very well be a connection to my Oliver line (available to anyone that asks.)

Gazette & Courier - Monday, December 28, 1874
History of the Dusinberry Family, which if established by evidence will secure to them the fortune of 20 millions [If at all true, the name is most probably Dusenberry]
History of the Dusinberry Family, which if established by evidence will secure to them the fortune of 20 millions [If at all true, the name is most probably Dusenberry] - After the time of the Revolution in England during the reign of Queen Anne, three brothers Dusinberry emigrated from Holland to America; two were farmers, and the other had received a medical education. Soon after their arrival in New York, one brother settled on Long Island. Another went up the Hudson and settled at Peekskill. The Doctor, however, not liking the country, went back to Holland, where soon after his return his father died, leaving considerable property. The Doctor, whose name was Moses, along with a sister in Holland, took possession of the property. Moses continued to practice medicine as a profession in Amsterdam, then the greatest commercial city in the world, and died at middle age unmarried, leaving a fortune of $185,000 to his sister Christine, under certain conditions. Before his death Christine had married one Brant by whom she had two sons; the marriage being distasteful to the Doctor, as Brant was a Jew. Accordingly Dr. Dusinberry had a clause inserted in his will that Brant should not receive any portion of his inheritance, nor his two sons who were also Jews, but at the death of the two sons the money should go to their children, if any were born to them when they became of age, provided they embraced the faith of the Lutheran Church. Failing issue, the money was to go back to his sister Christine if she were alive, but if dead, or at her death, was to go to the Dusinberrys in America. One of the Brants soon died without issue; the older brother left one child, a daughter who died at the age of 9 years. Consequently Christine obtained the property according to the terms of the will at the time of her death, which occurred in 1787, the heirs in America were advertised for. The Dusinberrys in America however, ahd become quite comfortable in circumstances and took no further notice of the matter. So things remained until about the year 1840, except that the fortune was often talked about in the family. About this time David Oliver of Cayuga Co., N.Y. married a daughter of William Dusinberry who was grandson of the brother Dusinberry, who setled at Peekskill on his arrival from Holland, commenced proceedings to obtain the money. His father-in-law was still living, who furnished him with valuable information. Mr. Oliver however, died 3 years after, and the matter was allowed to drop. The papers are in the possession of Elias Dusinberry of New York. In 1853 a suit was commenced by the descendents of the Brant family in Holland, to obtain possession of the property, but the courts decided that the Brants had no right to the money, and that the Dusinberrys were the rightful heirs. Later a connection of the family, Mr. Clinton Vantyle, a retired, wealthy New York merchant, began to interest himself in the matter, and proceeded himself to Holland to make inquiries. He returned in 1869 and engaged Mr. Humphreys, a claim searcher living at 202 Broadway, New York, to proceed to Holland to search up and investigate all the papers. Mr. Humphreys was engaged in this search 5 years, returning to New York last spring. A meeting of the heirs held June 18th, 1874, at which time Mr. Humphreys stated that the result of his 5 years labor would secure to them the money. At that time Mr. Humphreys, with Elias Dusinberry, one of the heirs, were appointed to go back to Holland in the month of August 1874 and take possession of the claim. Intelligence has been received, and heirs notified, that they will return in Dec. 1874, after which a meeting will be held, and heirs take possession of their claims. The grandfather of the heir who is a resident of this town was a grandson of the two brothers Dusinberry who settled in this country, the son of one of the emigrants having married a daughter of the other.

Is there anyone familiar with a black man named Levi Oliver (born 1892) in Orangeburg, SC? His mother name was Amanda Mitchell (1869). I do not know who his father is. Levi had 2 sisters (Henrietta & Elvira) and 3 brothers (George, Dennis, & Berley). He and his brothers eventually moved up North to the Philly area. Levi had a son named Nero Oliver, who may still be alive, and a daughter named Evanner, who is my grandmother. Any information would be helpful.

This was a private webpage he mounted and I assume that with his passing, it was not renewed.

Although I am the current administrator of this project, I did not have access to his webpage because it was private.

Please see http://www.familytreedna.com/public/oliverDNA/default.aspx for the current webpage about the Oliver Y DNA project at FTDNA.
Hi,

I found an interesting microfiche in the genealogy library this week.

The Loyalists of Ontario Microfiche 6046758
The Sons and Daughters of the American Loyalists of Upper Canada
By William D. Reid
Hunterdon House, Lambertville, New Jersey 1973
(Mr. Reid worked at the Ontario Archives)

“In the years following the close of the American Revolutionary War, the Loyalists who settled in Ontario were given land grants in partial recognition of their losses and services during that conflict. In addition, a provision was made that each of their children in turn were eligible for land grants free of fees as they came of age or married.

O.C. stands for Order-in-Council and pertains to when the son/daughter received the land grant. These records only list the name of the person (and husband) and the name of the father from whom this entitlement derived. The marriage dates, etc. are from other sources Mr. Reid found. Most records were in the Archives.

p. 239

Oliver, Aaron of Richmond m.

I am doing research on Olivers from Va. A ob. of a great uncle states that his father was from Va., his grandfather was from England. Would like to know if anyone researching Oliver from Endland came across the name Marshall Oliver.
Marshall was born around 1790. My first record of Marshall is 1802 Caroline Co. Va
